State Farm Files SR-22 But Renewal After DUI Is Not Automatic

Kansas DUI Creates Two Parallel Suspensions With Separate SR-22 Requirements

Kansas DUI triggers two suspensions: an administrative license suspension (ALS) through the Kansas Department of Revenue and a judicial suspension through the court. The administrative suspension begins 30 days after your arrest if you refused the breath test or failed it. The judicial suspension begins after conviction. Both suspensions require separate reinstatement processes, separate fees, and separate SR-22 filings if your administrative suspension was not already resolved.

The administrative suspension lasts 30 days for a first DUI. The judicial suspension also lasts 30 days for a first conviction under K.S.A. 8-1567. If both suspensions run concurrently, you serve 30 days total. If they run consecutively because the administrative suspension was contested and resolved later, you serve both periods separately. The SR-22 filing requirement applies to both tracks. The Division of Vehicles will not reinstate your license until an SR-22 is on file, the suspension period has ended, the $200 reinstatement fee is paid, and you complete a state-approved alcohol education course.

State Farm files SR-22 to satisfy this requirement. The filing itself costs nothing from the state — Kansas does not charge an SR-22 filing fee — but your carrier may charge a small one-time administrative fee. The SR-22 filing period in Kansas is one year from the date of filing, not from the date of conviction. If your SR-22 lapses during that year because your policy cancels or you fail to pay premiums, the Division of Vehicles suspends your license again immediately.

What Happens If State Farm Non-Renews Your Policy

Non-renewal is not the same as cancellation. State Farm will continue your current policy through the end of the term and file SR-22 if required, but they will not offer a new policy when the term expires.

You receive a non-renewal notice 30 to 60 days before your policy expiration date. Kansas law requires carriers to provide written notice before non-renewing a policy. The notice tells you the exact date your coverage ends. You have that window to secure a new SR-22 policy with a different carrier. If you do not secure new coverage before your State Farm policy expires, your SR-22 filing lapses the day your policy ends. The Division of Vehicles receives electronic notification of the lapse within 24 hours and suspends your license immediately.

The new suspension is indefinite. It remains in effect until you file a new SR-22 with a different carrier, pay a new reinstatement fee, and request reinstatement from the Division of Vehicles. If you are driving on a restricted license during this period, the lapse suspension revokes your restricted privileges immediately. Kansas does not provide a grace period for SR-22 lapses.

Kansas Restricted Driving Privileges Require Continuous SR-22 Coverage

Kansas allows restricted driving privileges during your DUI suspension if you meet eligibility requirements. The restricted license is called a modification of suspension under K.S.A. 8-2,142 and is issued by the Division of Vehicles, not the court. You apply using form DC-1015 for alcohol-related modifications. The restricted license allows driving for enumerated purposes: employment, schooling, in the course of employment, medical appointments, court-ordered probation or counseling, child transport, groceries and fuel, and religious worship.

The restricted license requires an ignition interlock device (IID) installed in any vehicle you operate. Kansas mandates IID for all DUI-related restricted licenses. The IID vendor reports compliance data to the Division of Vehicles monthly. If you miss a required IID service appointment, blow a failed test, or attempt to start the vehicle after a lockout, the vendor reports the violation and the Division of Vehicles revokes your restricted license without a hearing. SR-22 coverage must remain continuous during the entire restricted license period. If your SR-22 lapses, your restricted license is revoked the same day.

State Farm's post-DUI renewal decision determines whether you can maintain restricted driving privileges without interruption. If State Farm non-renews your policy and you do not secure replacement SR-22 coverage before your policy expires, you lose your restricted license and must reapply after filing a new SR-22. Do not wait for a non-renewal notice. If State Farm will renew, confirm the new premium, the policy term length, and whether your SR-22 filing will continue without interruption. If State Farm will not renew, ask your agent for the exact non-renewal date and begin comparing replacement carriers that day. Ninety days gives you time to secure quotes, complete underwriting, and transfer your SR-22 filing to a new carrier before your current policy expires. Thirty days is not enough time if underwriting delays occur or if the first carrier you apply to declines coverage.
